Referral Programme Terms & Conditions

These Referral Programme Terms and Conditions (“Referral Terms”) govern the referral programme (“Programme”) offered by flav& Ltd, C 116490, 4th Floor, Kingsway Palace, Triq ir-Repubblika, Valletta VLT 1115, Malta (“Company”, “we”, “us” or “our”).

By participating in the Programme, you agree to these Referral Terms together with our Terms and Conditions of Sale and Privacy Policy.

1. Eligibility

1.1. The Programme is available to existing customers aged 18 or over who are eligible to purchase our products (“Referrer”).

1.2. A person participating through a Referrer’s referral link is a “Referred Friend”. A Referred Friend must be a new customer who has not previously placed an order with the Company.

1.3. The Programme is available only in countries or territories where we make it available.

2. Referral Link

2.1. Each Referrer receives a personal referral link which may be shared with multiple Referred Friends.

2.2. Each eligible Referred Friend who meets the requirements in clause 1.2 and submits their email address through the referral link will receive their own unique discount code.

2.3. Referral links and rewards may not be sold, exchanged or used for fraudulent or commercial purposes.

3. Referred Friend Reward

3.1. An eligible Referred Friend will receive a unique, single-use discount code by email for 10% off any bundle. The discount is available only to new customers and may not be used by existing or previous customers.

3.2. The discount is subject to any conditions communicated with the code and cannot be exchanged for cash or combined with other promotional codes or offers unless otherwise stated.

3.3. Referral discount codes currently have no fixed expiry date. We may introduce or change validity periods for future rewards upon reasonable notice.

4. Referrer Reward

4.1. When a Referred Friend completes an eligible purchase through the Programme (“Qualifying Purchase”), the Referrer will automatically receive a unique, single-use code for 20% off one 4-pack of CO2 cylinders.

4.2. The reward is issued following the Qualifying Purchase without a waiting period and is subject to any conditions communicated with the reward.

4.3. Referral rewards have no cash value and cannot be exchanged for cash, credit or other compensation.

5. Fraud and Misuse

5.1. Participants must not misuse or manipulate the Programme, including but not limited to self-referrals, fictitious or multiple accounts, false information, artificial purchases, manipulation of returns or refunds, sale or exchange of rewards, or automated referral methods.

5.2. Where we reasonably determine that fraud, abuse or a breach of these Referral Terms has occurred, we may withhold or cancel rewards and suspend or exclude the participant from the Programme.

6. Personal Data

6.1. Personal data submitted through the Programme will be processed to administer the Programme in accordance with our Privacy Policy and applicable data protection laws.

6.2. Providing an email address to receive a referral discount does not constitute consent to receive unrelated marketing communications. Where consent is required, it will be requested separately.

7. Changes and General Terms

7.1. We may modify, suspend or discontinue the Programme, including the value or conditions of future rewards, upon reasonable notice where appropriate. Changes will not unfairly affect rewards already validly earned.

7.2. Nothing in these Referral Terms excludes or limits liability where it cannot lawfully be excluded or limited. Subject to applicable law, we are not responsible for referral links, codes or rewards that are lost or unavailable due to circumstances outside our reasonable control.

7.3. If any provision is invalid or unenforceable, the remaining provisions will continue in effect.

7.4. These Referral Terms are governed by the laws of Malta, without prejudice to any mandatory consumer protection rights under applicable law.

7.5. Alternative Dispute Resolution. The company is neither willing nor obliged to participate in dispute resolution proceedings before a consumer conciliation body.
